Overview
Several of our attorneys have extensive experience in assisting with the investigation of suspected fraud and defending lawsuits brought by policyholders suspected of engaging in fraud. Our lawyers have extensive knowledge of the applicable fraud statutes, arson-reporting immunity acts, state unfair claims practices, bad faith case law, and the fraud techniques used by criminals and scam artists against insurers. In addition to counseling insurers on potentially fraudulent claims, we also assist with taking examinations under oath, evaluating cause and origin investigations, and making recommendations regarding claims decisions. When litigation ensues, we also frequently defend our clients from allegations of improper claim denials and, if appropriate, prosecute our client’s claims to recover money when their insureds (and other conspirators) engage in fraud or other wrong doing against the insurer. We have successfully tried six cases to verdict across Texas as well as in five other states.
