Our lawyers have been at the forefront of foundation coverage litigation since it exploded in Texas in the early 1990s. On the coverage issues, our lawyers led the attacks on coverage in both the state and federal courts of Texas culminating in the Fifth Circuit’s declaration that such claims were not covered under Texas’ Homeowners Form B policy. When plaintiff lawyers and the Texas Department of Insurance pushed back and sought to re-establish the coverage for these claims, we worked with some of our clients to rewrite Texas homeowners’ policies resulting in the exclusion of these claims.

Our lawyers have tried more foundation damage cases to verdict than any other insurance lawyers in Texas in the last 15 years. Our lawyers have tried and arbitrated more than 100 of these disputes across Texas. As such, we know the plaintiff lawyers who specialize in these claims and the engineers and repair experts who testify in them. Our lawyers have tremendous depth of understanding regarding the principles of geotechnical engineering, water movement through clay soils, the effects of trees and vegetation on monolithic slabs, and the effects of seasonal moisture changes on slabs. In addition to this scientific expertise, because we are trial lawyers we know how to communicate such principles in a simple and understandable manner to Texas juries.
